Yotam Barkai⏐Counsel
Yotam Barkai is an experienced trial and appellate lawyer navigating high-stakes litigation across a broad spectrum of practice areas, including complex commercial disputes, antitrust matters, and appeals. His practice spans diverse sectors and industries, including technology, sports, real estate, energy, transportation, and financial services.
Yotam has successfully represented major corporations, government agencies, and individuals in high-profile business disputes, bet-the-company matters, and investigations. His recent commercial representations include defending Amazon in several putative class actions and government lawsuits asserting antitrust and consumer-protection claims; the Ultimate Fighting Championship in defense of antitrust class actions pursued by MMA fighters; Berkshire Hathaway Energy in defense of a nationwide antitrust class action involving real-estate commissions; and directors of the energy company Avangrid in defense of a shareholder class action.
Yotam also maintains robust appellate and pro bono practices, including his work on the landmark civil-rights case Sines v. Kessler, winning a groundbreaking verdict (and defending it on appeal) against the neo-Nazis and white supremacists responsible for the racially motivated violence in Charlottesville, Virginia, in August 2017. Yotam also represented survivors of the Highland Park mass shooting in litigation against Smith & Wesson, and has briefed, argued, and won appeals in the First, Third, Fourth, and Fifth Circuits in cases involving employment discrimination, immigration, the Armed Career Criminal Act, and police misconduct.
For the past several years, Yotam has been named to Best Lawyers: Ones to Watch for Antitrust Law and Commercial Litigation and Super Lawyers: New York Metro Rising Stars. Before entering private practice, Yotam clerked for the Hon. Stephen F. Williams of the U.S. Court of Appeals for the D.C. Circuit and the Hon. Katherine B. Forrest of the U.S. District Court for the Southern District of New York. Yotam taught sixth-grade math in the Bronx through Teach for America prior to his legal career and continues to volunteer with education-oriented nonprofit organizations.
