Amy Mauser is an experienced litigator focusing her practice on complex commercial litigation, with an emphasis on antitrust. For over three decades, Amy has represented clients in antitrust matters as plaintiffs and defendants in both federal and state courts at the trial and appellate levels, and in other high-stakes matters involving contractual claims, business torts, and constitutional claims. In addition to the depth of her litigation experience, for over six years, Amy oversaw the operations and management of the second-largest office of an AmLaw 100 firm.
Clients rely on Amy’s ability to manage all aspects of complex litigation, including class actions, develop and evaluate the facts and legal theories, and assess their relative strengths and weaknesses. She provides strategic guidance to achieve favorable outcomes in all phases of litigation, from preparing or responding to a complaint to appeal. Where parallel litigation exists outside the United States, Amy has worked closely with counsel in those jurisdictions.
Amy has the unique ability to develop novel arguments by building on prior precedents. In the government’s case to break up Google’s advertising business, for example, Amy developed the motion that successfully resulted in the Court striking the government’s jury demand after Google tendered a cashier’s check for the full amount of the United States’ claimed damages (less than one million dollars). Other examples include her work on a novel claim against the United States on behalf of a company’s shareholders alleging that the equity interest the government took in the company in exchange for a loan amounted to what the court concluded was an illegal exaction, and her development of antitrust counterclaims on behalf of a major seed company arising from the patent holder of the first biotech trait to go off patent trying to switch the industry to a successor trait prior to patent expiration, resulting in a favorable settlement for the seed company.
In addition to her litigation work, Amy provides strategic counseling to clients on how to improve their practices based on lessons learned during litigation, as well as on the contours of the attorney-client and work product privileges. She has also participated in presentations to the U.S. Department of Justice and the Federal Trade Commission on antitrust issues on behalf of clients.
Amy’s antitrust work has been recognized by Global Competition Review, and The American Lawyer has recognized the work of litigation teams she has played a leading role on, including for Amazon, Google, Apple, and International Construction Products.
